Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This research aimed to analyze and evaluate the correct and sufficient motivation in the judgments issued by first-level judges in Ecuador. Through a critical and analytical approach, it sought to assess whether these rulings comply with the established legal requirements, whether they provide an adequate examination of both the facts and the applicable legal framework, and whether they present clear and understandable argumentation for all parties involved. To this end, the following were used: schematization of judgment arguments, a questionnaire on the standard of sufficiency of motivation, a questionnaire on correct motivation, and the SATJE system, which allows for downloading the judgment under study. The results showed that the judgment on extraordinary acquisitive prescription of ownership complies with the legal requirements. The normative and factual basis is sufficient, without inconsistencies or contradictions. The judge resolved all pertinent points and adequately assessed the evidence. No vertical or horizontal appeals were filed, and the judgment was executed. It is concluded that the judgment analyzed complies with constitutional parameters, offering adequate and sufficient reasoning.
