Abstract: This research analyzes and evaluates the relevance of the judicial reasoning in Judgment No. 16201-2024-00240, concerning the post-mortem declaration of a common-law marriage. Through a detailed analytical methodology and the implementation of specific questionnaires, the interaction between doctrinal and jurisprudential review and the comprehensive assessment of documentary and testimonial evidence is examined, guaranteeing strict respect for due process. The study addresses the issue of the admissibility of this declaration after the death of one of the partners. It concludes that the ruling complies with the constitutional standards of correct and sufficient reasoning, demonstrating logical coherence and technical-legal quality by integrating the normative foundations with the factual circumstances. This contribution is vital for academia and the judicial system, as it reaffirms the protection of the survivors' property and family rights, preventing motivational flaws and strengthening the understanding of this guarantee in Ecuador.
