Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This thesis analyzes the correct and sufficient motivation in Judgment No. 03283 2025-01462, issued by the Criminal Judicial Unit based in the canton of Azogues, corresponding to a protection action for lack of registration of the grade on a high school diploma validated in Ecuador. The general objective was to analyze and evaluate the judicial motivation in first-level judgments, taking this ruling as a reference. The research was conducted in Ecuador and used Judgment No. 03283 2025-01462 as a sample. The analytical method was applied, breaking down the judgment into facts, grounds, and decision. In addition, techniques such as schematization, the EL SER method, the sufficiency standard questionnaire, and the correct motivation questionnaire were used, using the SATJE System as the instrument for obtaining the ruling. The results demonstrated that the ruling presents adequate legal and factual justification, guaranteeing the rights to education, equality, and non-discrimination. Furthermore, it was shown that the Multicompetent Chamber of the Provincial Court of Cañar upheld the decision on appeal, ratifying the ordered reparation measure.
