Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: The research addressed the motivation behind the judgments issued by first-level judges in Ecuador, with the general objective of determining the level of compliance with this constitutional requirement in judicial decisions. The study was conducted in the city of Machala and employed a mixed-methods approach with a descriptive scope. The sample consisted of one first-level judge from the Judicial Branch. The methods used were historical-logical and deductive, and the techniques applied consisted of a survey of judges and documentary analysis of judgments, using a questionnaire as the instrument. Finally, the general conclusion is that there is moderate compliance with the requirement of motivation, as it was found that judges, by citing legal norms, jurisprudence, and legal doctrine, can better justify their judgments.
