Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This research addresses the judgment of Trial No. 17811-2021 02549 before the Fifth Oral District Court of Administrative Litigation of the Metropolitan District of Quito, Pichincha Province, in matters of administrative litigation. This research had the general objective of analyzing and evaluating the correct and sufficient motivation in the judgments issued by first-level judges in Ecuador. The methodology used for this research was qualitative, with a documentary and descriptive purpose, in which the underlining technique was used. The most important point of this research was to determine whether the present judgment complies with the constitutional standards of sufficiency and whether it has the applicable legal regulations, which are found in Judgment No. 1158-17-EP-EP/21. The motivation issued by first-level judges in Ecuador was evaluated and analyzed, concluding that the majority of judicial decisions comply with a formal and sufficient structure in their motivation, guaranteeing their transparency and legitimacy in decision-making.
