Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: In this thesis entitled Motivation in Judgments Issued by First-Level Judges in Ecuador, the main objective is to analyze and evaluate the motivation of judicial judgments, verifying that it is correct and sufficient, as this aspect is fundamental given that the parties to the proceedings have the right to understand the reasons that support a judicial decision. The methodology employed is based on the analysis of the motivation of judgments, which stems from the analytical method that involves breaking down the judgment into its fundamental parts to analyze and evaluate the arguments separately. As a result, it is highlighted whether the judgments issued by first-level judges in Ecuador have sufficient and correct motivation. In the specific case analyzed, the judge's actions fully comply with the current legal framework, effectively resolve the conflict presented, and protect the fundamental rights of both the minor and the defendant, while simultaneously upholding the guiding principles of the Ecuadorian legal system.
