Abstract

Abstract: This legal research aims to provide an exhaustive analysis of judicial reasoning in divorce proceedings based on fault, using Judgment No. 07206-2022-00507 as a basis. Through a dogmatic, doctrinal, and jurisprudential study, the importance of sufficient, correct, and coherent reasoning is addressed, guaranteeing due process and the right to defense. The methodology employed is qualitative, with an interpretive and argumentative approach. The work demonstrates how a well-reasoned judgment ensures legitimacy, transparency, and effective judicial protection. Furthermore, it identifies flaws in reasoning and their legal implications. The study contributes to professional development and critical reflection on the role of the judge in the administration of justice. It concludes that deficient reasoning can lead to procedural nullity, judicial liability, and a direct impact on fundamental rights. This work constitutes an academic and practical resource for justice operators, teachers, and law students.
