Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This research essentially studies the analysis of judgments issued in Ecuador by first-level judges, delving into the importance of the reasoning behind judgments. It differentiates between the guarantees these judgments provide and how their deficiencies violate the rights of citizens who seek justice, ensuring transparency, legality, and legitimacy in the decisions made by judges. Reasoning is an essential element in law, as it guarantees due process, helping to recognize and verify legal and factual reasons based on established norms. This prevents arbitrary or unfounded decisions. Reasoning not only has a formal function but also assures citizens of a fair and understandable trial with an appropriate resolution, and provides means of appeal should the contrary occur. In this way, a specific sentence has been chosen to carry out its study and in-depth analysis, interpreting all its content in relation to the motivation, carrying out a doctrinal study of it.
