Abstract

Abstract:This study analyzes the legal reasoning of the judgment issued in criminal case No. 13283-2024-00559, whose central theme is the evaluation of the correct and sufficient reasoning in accordance with current doctrinal and jurisprudential standards. The general objective was to determine whether the judicial decision complies with the constitutional, legal, and technical parameters required for the proper justification of jurisdictional decisions. The research was conducted using as a sample the judgment issued by the First Level Criminal Guarantees Court. A qualitative approach with a non-experimental design and a descriptive-analytical scope was applied. The methods employed were case analysis, the analytical method, and the EL SER technique. The techniques and instruments included documentary analysis, jurisprudential review, questionnaires on sufficient and correct reasoning, and the schematization of judicial argumentation. The results show that the judgment presents sufficient and correct reasoning, with adequate evidentiary assessment and normative coherence, without incurring invalidating defects. It is concluded that there are no grounds for its annulment or correction on appeal.
