Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: The work entitled "Motivation in Judgments Issued by First-Level Judges in Ecuador" examines the importance of motivation in judicial decisions, specifically in judgments issued by first-level judges in Ecuador. This work studies the need for judgments to be well-founded beyond being a mere formality, as this is important for transparency, legitimacy, and the protection of the parties' rights. The author then analyzes the correct and sufficient motivation of judicial decisions, based on the correct interpretation and application of the constitutional principles of the right to effective judicial protection and the best interests of the child. Through a doctrinal and jurisprudential analysis, it is argued that adequate motivation not only facilitates access to justice but also strengthens trust in the judicial system and prevents arbitrary decisions.
