Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: Due process is considered a fundamental and essential right to ensure that any person involved in a legal process is treated fairly and within the established legal parameters. This process must include certain guarantees, such as legality, the presumption of innocence, the right to defense and to challenge evidence, the right to appeal, and the requirement of reasoned decisions, among others, which are fundamental to achieving the necessary sufficiency. Focusing on the guarantee of reasoned decisions, it is important to establish that this is an essential part of due process, as it requires judicial authorities to justify both the factual and legal reasons that led them to make a particular decision. Furthermore, these decisions must be coherent and clear, allowing citizens to understand the ruling. This study analyzes a case of increased child support payments, which meets the required and established parameters for the judgment to satisfy due process. In other words, the judge's decision demonstrates a logical connection between the facts and the law, thus resulting in a clear, sufficient, legitimate, and transparent ruling.
