Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: The present Curricular Integration Project aims to analyze and evaluate the correctness and sufficiency of judicial reasoning in judgments issued by first-level judges in Ecuador, based on the study of a labor judgment. Judicial reasoning is a fundamental element of due process, as it allows a clear understanding of the factual and legal grounds that justify a judicial decision, thereby ensuring transparency, coherence, and legal certainty. To achieve the general objective, this study focuses on the analysis of a first-level labor judgment. First, the arguments contained in the judicial decision are systematically outlined, identifying the legal issue, the relevant facts, the applicable legal rules, and the conclusion reached by the judge. The reasoning of the judgment is then examined to verify whether there is coherence between the proven facts, the assessment of the evidence, and the application of labor law. Finally, the sufficiency of the judicial reasoning is evaluated through the application of the sufficiency standard questionnaire, in order to determine whether the judgment is properly reasoned and complies with the parameters required by the Ecuadorian legal system and constitutional case law.
