Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: Within this research, the need to address the issue of motivation in first-level judgments in Ecuador has been raised, starting from the premise that these are essential and mandatory within the resolutions issued by authorities. Furthermore, the problem arises from the legal uncertainty that can occur due to their absence, as they are also considered constitutional guarantees and an important element that allows for the application of due process. In this context, it has been important to incorporate methodologies that have allowed for the collection of information, such as the quantitative and bibliographic methods, through which it has been possible to gather information for the development of this research. Within this framework, it has also been possible to analyze judgment 17250-2025-00009 in order to review the key aspects of its content and arguments to classify them as correct, sufficient, or insufficient as appropriate, with a detailed analysis. This has allowed for the application of acquired knowledge and the creation of a criterion I firmly believe in the importance of motivation for both students and the university.
