Motivación en las sentencias emitidas por los Jueces de primer nivel en Ecuador

Abstract

Abstract: The purpose of this research is to analyze whether the judgments issued by first-level judges in Ecuador are duly justified. Based on this premise, an exhaustive selection of a family law judgment was made, specifically one that addresses the challenge to an act of recognition through relative nullity. To frame the context of the judgment, its doctrinal section was examined, drawing on contributions from both national and international literature. Subsequently, the decision was analyzed in each of its parts. Questionnaires assessing the sufficiency of the justification and the correctness of the reasoning were applied. The results showed that the judge's decision is duly justified, as it respects the normative and factual foundations.
