Abstract

Abstract: The analysis of the reasoning behind the judgment in case No. 09359-2022-00541, which was the subject of this thesis, constitutes a fundamental and relevant contribution to understanding the foundations that form part of judicial reasoning as an essential element of due process and effective judicial protection in the Ecuadorian labor context. The study focuses on reviewing the argumentative structure of the ruling, evaluating the logical, factual, and legal coherence employed by the judge in supporting her decision regarding the challenge to the settlement agreement. It is evident that the reasoning of the judgment not only complies with the constitutional parameters of reasonableness, logic, and comprehensibility, but also reflects an exercise in judicial transparency. Likewise, this ruling illustrates how the judge applied the law in a balanced manner and, with equal coherence, carried out a critical assessment of the evidence, thus guaranteeing the effective protection of the labor rights of the affected workers.
