Motivación en las Sentencias emitidas por los Jueces de Primer Nivel en Ecuador

Abstract

Abstract: This research analyzes the reasoning behind judgments issued by first-level judges, focusing primarily on compliance with the constitutional, doctrinal, and jurisprudential standards applicable to such reasoning. The objective is to evaluate the sufficiency and correctness of the reasoning contained in the judgment of case No. 17230-2018-05392, determining whether it guarantees due process and the right to a defense. The research was conducted in accordance with the provisions of Constitutional Court Judgment No. 1158-17-EP. Furthermore, the methodology used was qualitative, descriptive, and documentary, employing techniques of bibliographic review, normative study, and argumentative analysis. Finally, it is evident that the judgment presents a sufficient, correct, and coherent motivation between the factual and legal grounds, without incurring any motivational flaws or deficiencies that affect its validity; that is, the judge acted in accordance with the required standards, contributing to the strengthening of the argumentative quality in judicial decisions.
