Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: The work focuses on the analysis of judicial motivation in the rulings issued by first-level judges in Ecuador, within the field of family law, with an emphasis on child support cases. The general objective is to evaluate the quality of the motivation and how it impacts the legitimacy of judicial decisions. To this end, a recent ruling related to child support, issued by judges in the country, has been selected. Regarding the methodology, a qualitative approach is employed, using documentary analysis techniques, reviewing rulings from first-level courts. As instruments, evaluation matrices have been used to analyze the coherence, sufficiency, and factual reasoning of the rulings. The results reveal that, in many cases, the rulings exhibit deficiencies in factual motivation, which affects the fairness and transparency of the decisions. It is concluded that proper judicial motivation is essential to ensure the right to due process, as well as to protect the fundamental rights of minors, particularly the best interests of the child.
