Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This study aims to analyze the motivation in judgments issued by first-level judges in Ecuador, using as a case study the judgment issued in the civil case of N.N. against the company N.N., in the canton of Atacames, province of Esmeraldas. Through the application of the EL SER method, the sufficiency standard questionnaire, and the correct motivation questionnaire, the normative and factual basis of the judicial decision was evaluated. The results show that the judgment meets the standards of sufficient and correct motivation, presenting a logical and coherent argument based on proven facts and applicable norms. No defects of non-existence, insufficiency, appearance, incongruity, or irrelevance were identified. The analyzed ruling guarantees the right to effective judicial protection, legal certainty, and due process. In conclusion, the study demonstrates that adequate motivation strengthens the legitimacy of the judicial function and constitutes an essential guarantee for respect for the rights of the parties in jurisdictional proceedings.
