Motivación en las sentencias emitidas por los jueces de Primer Nivel en Ecuador

Abstract

Abstract: This paper analyzes Judgment No. 09332-2025-00964 issued by the judges of the first level. Its main objective is to analyze and evaluate the correct and sufficient reasoning in the judgments issued by first-level judges in Ecuador. Through the application of the SER method and the questionnaires on sufficiency and correct reasoning, it is assessed whether the judicial decision complies with the constitutional standards of clarity, logic, autonomy, and justification established in Article 76 of the Constitution and in the jurisprudence of the Constitutional Court. The results demonstrate that the judgment presents adequate reasoning, both normative and factual, by coherently articulating the relevant facts, the applicable rules, and the final decision that nullifies the administrative sanction imposed by the Council of the Judiciary. Furthermore, the absence of horizontal or vertical appeals against the analyzed ruling is verified, which reinforces its argumentative sufficiency. The contribution of this research lies in highlighting the importance of a complete motivation as a guarantee of due process and an essential tool for strengthening judicial transparency and legitimacy.
