Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: The main objective of this work is to analyze the reasoning behind the judgments issued by first-level judges in Ecuador, focusing on its relationship with the principle of adequate justification. This analysis seeks to identify the characteristics and criteria applied by judges when issuing their rulings, in order to guarantee that judicial decisions are properly justified and that the fundamental rights of the parties involved are respected, especially the right to a reasoned decision, which is essential in the judicial process. Furthermore, it addresses how the reasoning behind judgments influences the legitimacy of the judicial system, ensuring that rulings are understandable and transparent to society. Throughout the research, different methodological tools were employed to examine the quality and coherence of the legal reasoning, highlighting those aspects that ensure impartiality and access to justice. In the chapters on literature review and results obtained, the national and international jurisprudence on the motivation in judgments was discussed, offering a critical reflection on its relevance in the Ecuadorian context.
