Abstract

Abstract: This Curriculum Integration Project aims to contribute to the resolution of the problem related to the potential insufficiency in the legal and factual foundations of judicial rulings in Ecuador, through an analysis of the reasoning in Ruling No. 09359-2023-01709, issued by the Guayaquil Labor Court, taking into account the constitutional context of due process and the right to defense. The focus is on evaluating whether this ruling met the standards of sufficient and correct reasoning. This research applied a qualitative and analytical approach, using the argumentative representation technique proposed by Atienza and the evaluation questionnaires of the Constitutional Court. It also examined motivational deficiencies such as non-existence, insufficiency, and appearance of motivation, and their resulting flaws within the ruling. The results show that the judgment contains formally adequate reasoning, although it presents interpretive limitations in the use of applicable rules. Finally, the importance of reasoning as a guarantee of due process is reaffirmed, and argumentative improvements are proposed to strengthen the legitimacy of such rulings.
