Abstract: Motivation within the legal sphere refers to the logical, factual, and normative basis that supports the decisions of authorities, being vital to ensure due process and the right to defense. In Ecuador, this motivation must be sufficient, although not necessarily correct, and its absence can result in the nullity of the act. There are several types of deficiencies and defects in motivation. In matters such as the voluntary acknowledgment of paternity, the law treats it as irrevocable, prioritizing the best interests of the child over biological truth. Errors in motivation can be remedied through legal appeals and could lead to civil, administrative, or criminal liability.
