Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: The research study, titled "Motivation in Judgments Issued by First-Level Judges in Ecuador," aimed to analyze compliance with the standards of sufficient and correct motivation in a protective action judgment, case number 23281-2021-01230, issued by the Criminal Guarantees Judicial Unit of Santo Domingo. The study was qualitative, descriptive, and analytical, based on doctrinal, hermeneutical, and comparative jurisprudential methods, complemented by the method of judicial case analysis. The results showed that the judge appropriately applied the Constitution, the Organic Law of Humanitarian Support, and constitutional jurisprudence, interpreting the rights of healthcare workers in a broad and inclusive manner. No motivational deficiencies or apparent flaws were identified; therefore, the judgment meets the parameters of sufficiency, reasonableness, and correctness required by the Constitutional Court. In conclusion, it was determined that the analyzed judicial reasoning guarantees due process, legal certainty, and the effective protection of fundamental rights.
