Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This work focuses on the analysis of judgments issued by first-level judges. The objective is to highlight the importance of providing reasons for judgments, explaining the concept of reasoning and its divisions, as well as the important factors that must be considered to ensure genuine motivation. It seeks to raise awareness of the concept of laws, as they are not arbitrary acts, but rather each plays an important role in jurisprudence, since power is not the primary reason for issuing a judgment. Additionally, an analysis of a child support judgment issued by a competent judge at first instance will be conducted. This will be done to demonstrate that the legal procedure was followed properly and legally, considering the parameters studied in this thesis; that is, that the judgment is correctly reasoned, learning to analyze it and applying the studied criteria to demonstrate that it is sufficient, clear, and precise.
