Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: The reasoning behind judgments is a fundamental constitutional guarantee for the transparency and legitimacy of justice. This research analyzed and evaluated the reasoning of the first-level judgment, case No. 18334-2023-01535, using a qualitative methodology, case analysis, and the application of the "EL SER" method, which allowed for the schematization of the argumentation. Specialized questionnaires were also used to evaluate the justification. The results obtained determined that the judgment meets the standard of sufficient reasoning because it does not present flaws such as inconsistency or insufficiency and approaches correct reasoning through the coherent application of legal norms and a logical assessment of evidence. In conclusion, the final decision should not be overturned or corrected by a second-instance court and constitutes a benchmark of good judicial practice.
