Abstract

Abstract: This thesis for the 2025 academic year seeks to link the Sustainable Development Goals (SDGs) through the study of court rulings, aimed at enabling law students to understand, promote, and implement the goals that are geared towards the development of the world's population. This study combines legal research with the objective of promoting societies that provide access to justice with effective and protective institutions at all levels. The selected subject is Constitutional Law and is linked to Sustainable Development Goal No. 16 Peace, Justice and Strong Institutions. The research conducted indicates that the Constitutional Court, in Judgment 2335-19-EP/23, determined that the right to motivation and legal certainty was violated. The purpose of this research is to prevent the violation of the rights to due process, motivation, and legal certainty in the resolution of jurisdictional guarantees that public servants activated due to the violation of their rights in sanctioning procedures resolved through constitutional channels due to the non-application of jurisprudential precedents.
