Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This research examines the reasoning behind the rulings issued by first-level judges in Ecuador, particularly through the analysis of Judgment No. 17204-2020-00994 issued by the Family, Women, Children and Adolescents Judicial Unit of Iñaquito, which resolved a protection action filed by a substitute worker for a person with a disability against the Council of Justice. The main objective is to determine whether first-instance judicial decisions meet the constitutional criteria of adequate and correct reasoning established by the Constitutional Court of Ecuador. The methodology used was the study of the reasoning behind the judgments through surveys, which evaluate the correctness of judicial argumentation. Through this process, it was determined that the judgment examined meets the constitutional requirements for reasoning, offering a complete normative and factual basis, without any motivational defects. From this, it can be deduced that judicial rulings can be issued that correctly balance legal certainty and respect for essential rights, and that judicial reasoning represents an effective guarantee of due process and democratic oversight of the judiciary.
