Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This research focuses on analyzing the reasoning contained in the judgment issued within criminal case No. 12336-2024-00472, related to the crime of illicit association. The study evaluates whether the judicial decision complies with the principles of sufficient and correct reasoning, as required by the Ecuadorian legal framework and current legal doctrine. A qualitative methodology and the EL SER method were applied to deconstruct and understand the arguments of the ruling, assessing their coherence, clarity, and justification. This review demonstrates that, even in abbreviated proceedings, the reasoning of a judgment must respect fundamental rights, offer reasoned explanations, and reflect a responsible decision. The study contributes to the critical understanding of judicial reasoning and promotes best practices in the drafting of criminal judgments. Furthermore, it strengthens professional learning from an ethical and technical perspective of law.
