Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract:This thesis addresses the issue of motivation in judgments issued by first-level judges in Ecuador, focusing on the analysis of judgment No. 01371-2023-00294 in labor law. The general objective is to evaluate the normative and factual basis of said ruling to determine its legitimacy and transparency. The research was conducted at the Universidad Técnica Particular de Loja, with a sample consisting of a single judgment from the Cuenca Labor Court. Qualitative methods were employed, such as doctrinal and single-case analysis, along with documentary and argumentative decision-making techniques. The instruments included structured annexes, as well as the SATJE system to verify procedural resources. In conclusion, the results of this investigative process demonstrate that the judgment under study is sufficiently motivated and justified, without any serious flaws being found in its logical-legal structure, and this finding was further ratified by the appeal judgment, which not only confirms the excellence of the first instance ruling, but also strengthens legal certainty in labor matters in Ecuador, generating confidence in the justice system.
