Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This thesis addresses the issue of motivation in judgments issued by first-level judges in Ecuador, with the objective of analyzing the relevance and implications of this judicial process in the Ecuadorian context. Judicial motivation, an essential component of procedural law, ensures that judges' decisions are understandable, logical, and based on law. This analysis delves into how motivation ensures respect for fundamental rights, such as the right to a defense and due process. Furthermore, it examines the different forms of sufficient and correct motivation, highlighting the standards that must be met for judicial decisions to be valid and legitimate. Finally, it offers an analysis of the procedural and constitutional consequences of a lack of motivation or deficient motivation. This study emphasizes the importance of clear and adequate motivation for the legitimacy of judicial decisions in the Ecuadorian legal system.
