Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuado

Abstract

Abstract: The work entitled "Motivation in Judgments Issued by First-Level Judges in Ecuador" aims to analyze the motivation of judicial judgments issued by first-level judges in Ecuador, specifically in the context of children's rights in child support cases. The study focuses on analyzing sufficient and correct motivation in judicial decisions, highlighting its importance in guaranteeing due process, judicial transparency, and the democratic legitimacy of the judiciary. Motivation must allow the parties to understand the reason for the decision, as well as how the judge reached that conclusion. The judgment should not be an enigma but rather a reasoned explanation through which litigants can address the causes and effects of the determination. Therefore, the study will analyze how a lack of motivation leads to human rights violations and how the infringement of fundamental rights is justified in certain cases. The work also analyzes deficiencies in motivation, insufficiency or appearance of motivation, and their relevance to the effectiveness of justice.
