Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This document comprises an investigative study within the framework of the thesis work, which has as its object the study of Judgment No. 199001-2020-00007, as recorded in the system E-SATJ 2020-CONSULTA DE PROCESOS , on the website of the Council of the Judiciary, the subject of study, interpretation and analysis being the corresponding Motivation, as well as its variables prior to its resolution, given that the guarantee of Motivation is constituted or is understood as the essential form of the law, based on sufficient legal and factual support prior to the issuance of its judgment. This case study developed a methodology for gathering information about the dismissal of an employee from the company Vialachin EP. The employee filed a protective action, which the judge subsequently ruled in favor of, finding arbitrary action on the part of the employer in violating the employee's rights.
