Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This paper analyzes the reasoning in judgments issued by first-level judges in Ecuador, with the purpose of evaluating their sufficiency, correctness, and appropriateness in accordance with the constitutional and legal principles governing due process. The research focuses on the study of criminal case No. 17282-2016-01441, related to the crime of illicit trafficking of controlled substances, in order to identify, in first-level judgments, compliance with the standard of reasoning required by the Constitutional Court. A qualitative approach was used, based on documentary review, jurisprudential and doctrinal analysis, allowing the determination of the main motivational deficiencies that affect the validity of judicial decisions. The results demonstrate the need to strengthen legal argumentation and the importance of judges properly justifying their rulings, as this guarantees transparency, legal certainty, and respect for fundamental rights. The study contributes to improving judicial practice and strengthening the Ecuadorian justice system.
