Motivación en las Sentencias emitidas por los Jueces de primer nivel en Ecuador

Abstract

Abstract: This work is the result of research into the motivation behind judgments issued by first-level judges in Ecuador. It offers a different perspective on how due process should be guaranteed through the provision of reasoned judgments. Since this is a set of rules closely related to ensuring a correct procedure for the parties involved, and especially given the circumstances that involve rights, it is essential to be meticulous in the application of justice. Furthermore, thanks to the research, study, and analysis of first-level judgment 17983-2022-01130 from the Family, Women, Children, and Adolescents Chamber, it is demonstrated that the judge complied with the standards of reasoned judgment established as jurisprudence by the Constitutional Court, demonstrating thoroughness in their decision. Furthermore, it was identified that there are no motivational flaws within the ruling since it contains clear rules, the factual and legal basis is coherent, relevant, and consistent.
