Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This paper analyzes the reasoning behind a first-level ruling issued by the Family, Women, Children and Adolescents Judicial Unit of Cuenca, in case No. 01204-2022-06897, concerning paternity recognition and the establishment of child support. Its objective is to evaluate the sufficiency and correctness of the judicial reasoning through the application of the EL SER method and two assessment instruments: the sufficiency standard and the correct reasoning standard. The qualitative and analytical research identified that the ruling complies with the constitutional and legal parameters for reasoning, although it presents minor deficiencies in the specific application of the law and in the relevance of certain secondary arguments. It is therefore concluded that the decision is coherent, consistent, and legally valid, guaranteeing the best interests of the child and the right to identity. The study provides a practical tool to strengthen the argumentative quality of judicial decisions.
