Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This research addresses a core issue for the quality of justice in Ecuador: the reasoning behind the judgments issued by lower court judges, which acts as the cornerstone of the legitimacy of judicial decisions and a crucial efficiency filter for decongesting the judicial system. The requirement of sufficient and technically rigorous reasoning is fundamental not only to guarantee full redress for violated rights, but also to prevent the revictimization of citizens, especially those belonging to vulnerable groups an imperative that requires the adoption of a zero-tolerance approach. To analyze the effectiveness of this pillar, a ruling from the SATJE system (Ecuadorian Automated Judicial Processing System) will be examined, corresponding to a Protection Action for the violation of the Right to Health, seeking to determine if the ruling meets the standards of technical rigor, applies a vulnerability perspective, and ensures logical reasoning that avoids new states of defenselessness. The recommendations derived from this analysis, focused on strengthening judicial training and establishing supervision and quality control mechanisms, seek to consolidate public trust in a justice system that offers fair, legal, and legitimate decisions from the first instance.
