Abstract

Abstract: This paper analyzes the judgment issued in case No. 04306-2024-00173, which addresses the validity of a bill of exchange as an enforceable instrument. In this case, the judge determines whether the document meets the formal requirements established by the Commercial Code to be recognized as a valid enforceable instrument. The court dismisses the claim, considering that the blank signature and subsequent modifications to the document affect its authenticity and validity. This study highlights the importance of having clear and genuine agreements in a commercial contract so that, in case of breach, it can be enforced. It also emphasizes respect for due process and equality in the application of the law, where the judge acted lawfully to safeguard, to the extent possible, the rights of the parties involved. This work contributes to the understanding of the legislation that regulates enforceable instruments and how commercial documents must meet the requirements to be legally valid.
