Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This research project analyzes the motivation and justification of the judgment issued in labor matters within the Ecuadorian judicial context. The main objective was to evaluate whether the judgment complies with the constitutional and legal standards of justification, and whether the assessment of testimonial and documentary evidence was adequate. The research, conducted in the legal field, used methods such as drafting, questionnaires on motivational relevance, and a critical review of the law with a sample corresponding to the first-instance decision in labor cases. The results show that the sanction is a logical and coherent motivation, based on the norms of the Labor Code and constitutional principles, because the evidence is correctly evaluated and the relationship is relevant to the decision. Furthermore, it is evident that the appeal process is indispensable when one of the parties challenges the judgment and that its review corresponds to a higher court, thus guaranteeing the effective protection of the right to a second instance. The overall conclusion reaffirms that the analyzed ruling meets the requirements of sufficient motivation, contributing to the strengthening of labor justice in Ecuador.
