Abstract

Abstract: This research analyzes the legal reasoning in the judgments of first-instance judges in Ecuador, focusing on the case of Judgment No. 17240202000016. This ruling addresses the violation of the labor rights of a breastfeeding woman by the Ministry of Culture and Heritage. The study identifies that judicial reasoning is not only a formal obligation but also a pillar of due process, allowing for transparency, legal oversight, and the protection of fundamental rights. Different types and standards of reasoning are distinguished: correct, sufficient, and insufficient, as well as flaws such as incoherence or incongruity. The methodology employed includes doctrinal, normative, and jurisprudential analysis, applying standards of sufficiency and correctness. The study concludes that the analyzed judgment presents complete and adequate reasoning, without substantial deficiencies. As a result, measures of redress, reinstatement, and financial compensation are established. This work contributes to strengthening the legal culture that guarantees rights, proposing a critical reflection on the argumentative quality of judicial decisions, especially in cases with a focus on gender and labor rights.
