| Abstract: | Abstract: This study aims to analyze the reasoning in the judgment issued in case No. 09202-2025-00680, in order to determine whether it meets the standards of sufficient and correct reasoning established in the Ecuadorian legal system. The research was conducted using a qualitative approach with quantitative support, employing the case study method and document analysis. A judgment analysis guide was applied, allowing for the evaluation of criteria such as the narration of the facts, the legal issue, the argumentation, sufficient reasoning, and correct reasoning. The results show that the judgment presents partial reasoning, since, although it contains legal grounds, there are deficiencies in the clarity of the reasoning, the formulation of the legal issue, and the connection between the facts and the applied legal norms. It is concluded that the judicial reasoning analyzed does not fully comply with the required standards, which demonstrates the need to strengthen the argumentation in judicial decisions in order to guarantee due process and legal certainty. |
| Description: | Resumen:El presente estudio tiene como objetivo analizar la motivación en la sentencia emitida dentro del proceso Nro. 09202-2025-00680, con el fin de determinar si cumple con los estándares de motivación suficiente y motivación correcta establecidos en el ordenamiento jurídico ecuatoriano. La investigación se desarrolló bajo un enfoque cualitativo con apoyo cuantitativo, utilizando el método de estudio de caso y el análisis documental. Se aplicó una guía de análisis de sentencia que permitió evaluar criterios como la narración de los hechos, el problema jurídico, la argumentación, la motivación suficiente y la motivación correcta. Los resultados evidencian que la sentencia presenta una motivación parcial, ya que, aunque contiene fundamentos jurídicos, existen deficiencias en la claridad del razonamiento, la formulación del problema jurídico y la conexión entre los hechos y las normas aplicadas. Se concluye que la motivación judicial analizada no cumple plenamente con los estándares exigidos, lo que evidencia la necesidad de fortalecer la argumentación en las decisiones judiciales, a fin de garantizar el debido proceso y la seguridad jurídica. |
