Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This thesis research addresses the topic of Motivation in Judgments Issued by First-Level Judges in Ecuador, whose general objective is to analyze the sufficiency, correctness, and coherence of judicial motivation as a guarantee of due process and the right to defense. The research was conducted in the city of Loja, using as a sample a set of judgments issued by first-level judges in civil and family matters, selected through purposive sampling. The methodology applied was qualitative, with a documentary and jurisprudential approach, using content analysis and literature review techniques. The instruments used included jurisprudential record sheets, comparative matrices, and criteria of the Constitutional Court of Ecuador to evaluate the sufficiency of the motivation. The results show that, although there has been progress in the justification of judicial decisions, deficiencies such as incoherence, insufficiency, and a mere appearance of motivation persist, which affects effective judicial protection. In conclusion, it is determined that strengthening the motivation in judgments is essential to guarantee transparency, legal certainty, and public trust in the judicial system.
