Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This thesis addresses the motivation behind judgments issued by first-level judges in Ecuador, a topic of vital importance for guaranteeing rights and the proper administration of justice. The research explores the relevance of motivation as a fundamental pillar of due process, analyzing how sound and transparent legal argumentation in judicial decisions contributes to their legitimacy and acceptability. It examines current Ecuadorian regulations and relevant legal doctrine, identifying the criteria and standards that judgments must meet to be considered duly motivated. The contribution of this study lies in offering a critical analysis of the current situation, highlighting potential shortcomings or areas for improvement in the practical application of the principle of motivation. It seeks to demonstrate how the lack of adequate motivation can lead to arbitrary actions, violations of rights, and distrust in the judicial system. Furthermore, it is proposed to strengthen the continuing education of judges in legal argumentation techniques and the drafting of judgments, in order to optimize the quality of their rulings. This work contributes to the academic and practical discussion on the importance of judicial reasoning, promoting transparency, legal certainty, and access to more equitable justice in Ecuador.
