Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This research focuses on analyzing and evaluating the motivation in the judgments issued by first-level judges in Ecuador, centering on the study of case No. 01283202300749 for the crime of robbery with a conciliation agreement. An analytical methodology is applied that includes the schematization of arguments, the review of the factual and legal basis, and the evaluation of the standards of sufficient and correct motivation established by the Constitutional Court. The results demonstrate that the analyzed judgment meets the requirements of clarity, coherence, and exhaustiveness without presenting motivational deficiencies such as non-existence, insufficiency, or apparent lack thereof. It is thus concluded that judicial motivation is fundamental to guaranteeing due process, effective judicial protection, and the legitimacy of the justice system, and this research is considered to contribute methodological criteria for the analysis of the argumentative quality of judicial decisions.
