Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: The thesis entitled "Motivation in the Sentences Issued by First-Level Judges in Ecuador" aims to examine the judgment under study on family, women, children, and adolescents, case No. 01658-2025-00005, with respect to a thorough analysis of the arguments and reasons on which the judge bases his decision in the judicial process in the judgment, based on precise and necessary concepts of motivation, its basis, its purpose, etc. Through the study of doctrine, law, and jurisprudence, the author will arrive at a deep understanding to determine whether a judgment or judicial ruling complies with the parameters that motivation must contain, in which it must be sufficient, correct, and reasoned. A thorough study of correct and sufficient motivation will be conducted to verify and analyze the judgment under study whether or not it complies with the characteristics and parameters of law and jurisprudence, thereby determining argumentative or normative deficiencies in the different judicial resolutions. This will serve as an additional contribution to scholars and professionals in the legal field.
