Abstract

Abstract: The ruling under study conducts a thorough examination of whether the constitutional principles of global environmental treaties align with the country's Constitution. According to Dr. NN, who holds the position of National Legal Secretary of the Presidency of the Republic, through Official Letter No. T. 7340-SGJ-16-498 of August 23, 2016, he notified the Constitutional Court about the signing of the Paris Agreement, which was adopted in December 2015 during the Conference of the Parties to the United Nations Framework Convention on Climate Change COP 21, and which Ecuador signed on June 26, 2016. The agreements that align with the essential principles of the Ecuadorian Constitution, the protection of the right to a healthy environment, reviewing the legality of the provisions, ensuring that they do not infringe the norms, likewise investigating the status within the legal system of Ecuador, establishing whether they have priority over national regulations or whether it is necessary to make modifications to the regulations in order a proper application.
