Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: The research work carried out contributes through the observation, exploration, examination, schematization, and critical approach to the motivation, argumentation, and legal composition of a judgment; whose subject matter is Traffic Law (COIP), with the process number 17460-2024-03453, in which the type of action is traffic violations (art. 387, inc. 1, num. 1 second-class traffic violations), issued by the Specialized Judicial Unit for Traffic with Jurisdiction over Flagrant Offenses, based in the Metropolitan District of Quito. This study of the motivation of the indicated judgment serves to determine how legitimate and credible it is. This being evaluated within the normative, doctrinal and legal framework through the development of the Puzzle project, providing a novel methodological instrument that consists of the decomposition, schematization, application of the sufficiency standard, the quality of the judgment through correct motivation and evaluation of the motivations or resolutions of the judge, contributing to the quality of the structure of the motivational foundations, from a didactic perspective in both theory and practice.
