Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract:This paper analyzes the judicial reasoning in Judgment No. 09209-2025-00524, issued by the Family, Women, Children, and Adolescents Judicial Unit of the Guayaquil canton, related to the challenge of the voluntary acknowledgment of maternal filiation. The research employs a qualitative, descriptive, analytical, and documentary approach, based on a review of normative, doctrinal, and jurisprudential sources. It examines the argumentative structure of the judgment, the application of the principle of biological truth, and the use of DNA evidence as a determining factor in guaranteeing the right to identity. Furthermore, it evaluates the sufficiency, coherence, and correctness of the judicial reasoning within the context of Ecuadorian constitutional guarantees. The results demonstrate that adequate judicial reasoning strengthens transparency, effective legal protection, and public trust in the administration of justice. The study contributes to the academic debate on the relationship between judicial motivation, fundamental rights, and family justice in Ecuador.
