Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This study examines the reasoning behind judgments issued by first-level judges in Ecuador, focusing on standards of sufficiency and correctness. Through the analysis of a divorce case based on fault, the key elements that guarantee clear and argumentatively coherent legal grounding in judicial decisions are identified. The importance of precise reasoning to strengthen transparency and legitimacy in the exercise of the judicial function is discussed. The doctrinal and jurisprudential review establishes criteria for evaluating the quality of argumentation in the judgment, determining the essential requirements for complying with the constitutional principles of due process and legal certainty. Furthermore, the impact of proper reasoning on the effectiveness of the right to defense and the protection of the fundamental rights of litigants is highlighted. Finally, the study provides analytical tools for evaluating judicial reasoning, allowing for improvements in the standards of justification in first-instance rulings. Through this work, the aim is to contribute to strengthening the administration of justice by promoting judicial decisions.
