dc.descriptionResumen:El presente trabajo analiza la sentencia No. 07712-2019-00553, emitida por la Unidad Judicial Multicompetente Penal de Huaquillas, relacionada con un procedimiento abreviado por el delito de robo. Se examina la motivación judicial, identificando la ratio decidendi y los obiter dicta, evidenciando cómo el juez fundamenta la condena de los procesados conforme al Código Orgánico Integral Penal y a la Constitución de la República del Ecuador. El estudio resalta la aplicación de principios procesales como oralidad, debido proceso, presunción de inocencia y la eficacia del procedimiento abreviado como mecanismo de simplificación y celeridad. Además, se analizan los elementos de prueba, la aceptación de cargos por los imputados y la legitimidad de la sanción impuesta. Este trabajo contribuye a la comprensión de la correcta motivación judicial y su impacto en la garantía de derechos y seguridad jurídica, sirviendo de referencia para el estudio doctrinario y jurisprudencial en materia penal en Ecuado.es_ES
dc.description.abstractAbstract: This paper analyzes Judgment No. 07712-2019-00553, issued by the Multicompetent Criminal Judicial Unit of Huaquillas, related to an abbreviated procedure for the crime of robbery. The judicial reasoning is examined, identifying the ratio decidendi and obiter dicta, demonstrating how the judge justifies the conviction of the defendants in accordance with the Comprehensive Organic Criminal Code and the Constitution of the Republic of Ecuador. The study highlights the application of procedural principles such as orality, due process, presumption of innocence, and the effectiveness of the abbreviated procedure as a mechanism for simplification and expediency. Furthermore, the evidence, the defendants' acceptance of charges, and the legitimacy of the imposed sanction are analyzed. This work contributes to the understanding of proper judicial motivation and its impact on the guarantee of rights and legal certainty, serving as a reference for doctrinal and jurisprudential study in criminal matters in Ecuador.es_ES
