| Abstract: | Abstract: The double registration of title deeds constitutes a recurring legal problem in the acquisition of real estate, generating conflicts regarding the determination of property rights and legal certainty. In this context, the present research aims to analyze and evaluate the correct and sufficient reasoning in the judgments issued by first-level judges in Ecuador, specifically in cases related to the double registration of title deeds for the same property. The research adopts a mixed approach, of a legal-doctrinal and jurisprudential nature. The methodology used is based on the analysis of the reasoning in judgments, using the analytical method, which allows the judicial decision to be broken down into its essential elements to examine and evaluate the arguments used by the judge. To this end, the argumentation contained in a first-level judgment is outlined, and the sufficiency and correctness of the reasoning are evaluated through the application of instruments based on the standards of sufficient and correct reasoning. As a result of the analysis, it is determined that, in cases of double registration of titles transferring ownership, proper judicial reasoning requires a comprehensive examination that is not limited to the registration aspect, but also considers the legal requirements for the validity of the title and the possession of the real estate. Consequently, it is concluded that, under the legal parameters analyzed, the first validly registered title of ownership prevails, provided that the judicial decision is duly reasoned, thus guaranteeing legal certainty and effective judicial protection. |
| Description: | Resumen:La doble inscripción de títulos traslaticios de dominio constituye un problema jurídico recurrente en la adquisición de bienes inmuebles, al generar conflictos sobre la determinación del derecho de propiedad y la seguridad jurídica. En este contexto, la presente investigación tiene como objetivo general analizar y evaluar la motivación correcta y suficiente en las sentencias emitidas por los jueces de primer nivel en el Ecuador, específicamente en casos relacionados con la doble inscripción de títulos de dominio sobre un mismo bien inmueble. La investigación adopta un enfoque mixto, de carácter jurídico doctrinario y jurisprudencial. La metodología utilizada se fundamenta en el análisis de la motivación de sentencias, a partir del método analítico, el cual permite descomponer la decisión judicial en sus elementos esenciales para examinar y evaluar las argumentaciones empleadas por el juzgador. Para ello, se esquematiza la argumentación contenida en una sentencia de primer nivel y se evalúa la suficiencia y corrección de la motivación mediante la aplicación de instrumentos basados en los estándares de motivación suficiente y motivación correcta. Como resultado del análisis, se determina que, en los casos de doble inscripción de títulos traslaticios de dominio, la correcta motivación judicial exige un examen integral que no se limite al aspecto registral, sino que considere los requisitos legales de validez del título y la posesión del bien inmueble. En consecuencia, se concluye que, bajo los parámetros jurídicos analizados, prevalece el primer título de dominio válidamente inscrito, siempre que la decisión judicial se encuentre debidamente motivada, garantizando así la seguridad jurídica y la tutela judicial efectiva. |
